TERMS OF SERVICE
Effective date: January 14, 2022.
1. INTRODUCTION
Amadeux offers a funding program called the 'Amadeux Challenge', accessible through the website www.amadeux.com and its subdomains (the"Website"). By acquiring and participating in the 'AmadeuxChallenge', you agree to comply with the terms and conditions set forth in this Agreement, as well as our Privacy Policy and Cookie Policy. Service Provider: Amadeux LLC, located at 224 W 35th St, Ste 500, Manhattan, NY 10001, UnitedStates of America ("Amadeux" or "We").
2. Registration and Acceptance of Terms
2.1 Registration: To access and use Amadeux services, you must register by creating an account on our platform. During the registration process, you will be required to accept these Terms by checking a verification box.
3. 'Amadeux Challenge' Funding Program
Amadeux is a training platform for traders, aiming to train profitable traders through a funding program called the ‘Amadeux Challenge’. The program is a training exercise that combines the use of demo accounts and Amadeux's advanced training platform.
3.1 Program Acquisition
The acquisition of the 'Amadeux Challenge' program isonly possible after accepting the Terms of Service, the Privacy Policy, and the use of cookies during the registration process.
3.2 Program Operation
By acquiring the program, the trader gains access tobroker accounts and our training platform. This platform collects data ontrades made in the accounts, in each tick or time frame, to analyze compliance with the established rules. The trader has a profit target in each evaluation stage, among other rules, when reached, they proceed to the next stage until acquiring the funded account, which allows them to earn rewards.
3.3 Rewards in Funded Account
We offer a reward for achieving consistent profits inan account we call the "Funded Account". In the first withdrawal made from the funded account, 100% of the payment made for the completed program isreturned. The trader can withdraw 80% of the profits, with these withdrawals subject to program rules, withdrawal conditions, and the scale plan.
3.4 Service Rules
The service rules and specific agreements between Amadeux and the client are reflected in these Terms of Service and private contracts and must be respected at all times.
4. Right to Block Access
4.1 Policy Violations: We reserve the right to block access to the website and services to any client who violates our usage policies, without prior notice.
4.2 Reputational Damage: Users must respectour brand and uphold our reputation. If a user damages our reputation, were serve the right to deny them access and cancel contracted services.
5. User Obligations
5.1 Truthful Information: You agree to provide truthful and complete information during the registration process and to keep such information updated.
5.2 Compliance with Rules: You agree to comply with all service rules established on our website and in any private agreement with Amadeux.
5.3 Right to Honor: You agree to respect the honorability of the company and not to spread false information. Any action damaging the reputation, such as false reviews, will be considered a breach of contract.
6. Intellectual Property
6.1 Property Rights: All intellectual property rights related to the platform, services, trading account data, and content provided by Amadeux are the exclusive property of Amadeux. Amadeux reserves the right to use all evaluation data for the creation of proprietary technology and 'Amadeux' artificial intelligence.
6.2 Brand Usage: Users may not use the Amadeux brand without prior written consent from Amadeux. Any unauthorized use of our brand will be considered a breach of these Terms.
7. Limitation of Liability
7.1 Services Provided "As Is": Amadeux services are provided "as is" and "as available". We do not guarantee that the services will beerror-free or uninterrupted.
7.2 Limited Liability: To the maximumextent permitted by law, Amadeux will not be liable for any indirect,incidental, special, consequential, or punitive damages, nor for any loss ofprofits or revenues, incurred directly or indirectly, or any loss of data,broker account cancellations, use, goodwill, or other intangible lossesresulting from your use or inability to use the services. User-traded symboldata is only provided by independent brokers subject to regulations. Amadeuxdoes not intervene in any case in: trade execution, prices, spreads,commissions, or symbols offered by the broker.
8. Compliance with Applicable Regulations
None of the services provided to the client by Amadeux can be considered investment services. Amadeux does not give or provide the client with any guidance, instructions, or information on how or in what manner the client should conduct transactions when using the services orother wise, nor any similar information on traded investment tools, and Amadeux does not accept such guidance, instructions, or information from the client. Neither the services nor the recommendations constitute investment advice.Amadeux employees, staff, and representatives are not authorized to giveinvestment advice or recommendations. If any information or statement fromAmadeux employees, staff, or representatives is interpreted as investment advice or recommendations, Amadeux explicitly disclaims that such information or statement constitutes investment advice or recommendations and will not beliable for them.
9. Know Your Customer (KYC)
Amadeux implements robust and comprehensive procedures in accordance with legal and regulatory requirements regarding Know-Your-Customer (KYC) policy, Customer Due Diligence (CDD), and Enhanced Due Diligence (EDD).
9.1 KYC Objectives:
● Establish an efficient mechanism to identify and verify potential clients.
● Mitigate money laundering risks through the acquisition and analysis of relevant information.
● Facilitate the detection of suspicious transactions by identifying inconsistencies with received information.
9.2 KYC Procedures:
● KYC verification must be performed solely by the individual account holder. KYC verification by multiple individuals for asingle account is strictly prohibited.
● Identity verification will be based on original or duly certified documents.
● The client must provide valid documents such as a photo ID, including: national ID card, passport, or driver's license.
9.3 Customer Due Diligence (CDD):
● Collect verifiable client identification data tounequivocally establish their identity.
● Understand the nature and purpose of the client's trading activities.
● Continuously monitor trading activities to ensure theyare consistent with the declared trading strategy.
9.4 Enhanced Due Diligence (EDD):
● Implement additional verification measures for business relationships or transactions that present a high risk.
● Obtain additional identity verification documentation.
● Conduct detailed interviews to assess the legitimacy of the client.
● Intensively monitor the client's trading activities to evaluate adherence to agreed practices.
10. Program Rules
To access the funded account, you must reach the profittarget in your account's closed balance, with no open trades and meeting theminimum number of trading days, without violating any program rules orprohibited practices mentioned below. The program rules specified on thewebsite and in private agreements are subject to modifications as follows:

11. Operating Requirements
Inactive Account: A trading account will become inactive if it does not receive any order to open or close a position for a specific period of time. The time may vary by broker; generally, if an account is not traded for 15 days, the account will become inactive. If your account becomes inactive, you must contact support to have it reinstated, provided no trades have been made. Other wise, the challenge will be marked as failed.
12. Permitted Practices
● Program Start Date: The user can start trading their account whenever they wish, and the program begins to be evaluated after the first trade is introduced.
● Holding Trades Overnight: You are allowed to hold trades overnight.
● Trading During News and Weekends: You are allowed to open, hold, and close trades during economic news, weekends, and holidays.
● Automated Systems (EA or Similar): The use of Expert Advisors and automated systems that do not engage in prohibited practices described below is allowed.
● Trader Copiers: The use of copiers to replicate user trades across different platforms is allowed.
● Account Merging: Users are allowed to merge their funded accounts with the same currency, up to $450,000, by requesting support.
13. Prohibited Practices
13.1 Trading Prohibitions: It is prohibited for clients to engage in trading practices that contravene the stipulations set forth in this section or the FAQs. Prohibited practices include, but are not limited to:
● Using trading strategies that exploit service errors.
● Conducting trades using external data or slow data feeds.
● Using software or artificial intelligence to manipulate or abuse systems.
● Latency Trading.
● Engaging in any form of arbitrage.
● Coordinating with others to manipulate the market.
● Hedging or Group Hedging: Opposing buy-sell trades in the same or different accounts.
● High-frequency trading and tick scalping.
● Martingale strategies.
● Copying or replicating third-party trades. Hyperactivity: Excessive order entries, common with HFT systems.
13.2 General Prohibitions: It is prohibited for clients to violate the following practices, among others:
● We do not allow minors to register on the platform and purchase our services.
● Accounts are non-transferable; another person cannot trade on a client’s trading account.
● Modifying trading account credentials is prohibited. If your account security is compromised, you must contact support immediately. Blaming the company for poor results is not allowed. Amadeux only conducts evaluations on Regulated and Independent Brokers, so exercise caution and apply good practices: during low-volume periods at the Broker, Stop Losses may fail due to a lack of counterparties in the order book, especially with non-Market Maker brokers. During high volatility periods, spreads may widen, potentially affecting you during a position closure. Anticipate these situations.
13.3 Consistency Rules: Users commit to respecting consistency rules. In case of violation, Amadeux has the sole discretion to decide if the user's account will be reset, and at what stage of the program the reset will occur, based on when the violation occurred.
● Daily Profit Limit: To promote responsible trading and avoid significant risks, users cannot achieve more than 30% of the profit target in a single day during evaluation stages. This measure reinforces the daily loss rule, fostering appropriate risk management even when the account is profitable.
○ Example in Evaluation Stages: For an account with an initial balance of $100,000, assuming a profit target of 8% ($8,000), 30% of this target is $2,400. Therefore, the user cannot earn more than $2,400 in a single day during the current evaluation stage.
● Volume and Number of Trades: Users must maintain consistent volume and number of trades throughout their trading. The daily lot size should be coherent with previous trades, allowing for a variation margin between half and double the average daily volume.
○ Example: If a user trades with an average daily volume of 10 lots, future trades should range between 5 to 20 lots per day. This rule prevents significant deviations and promotes stability in trading style.
13.4 Consequences: If the client engages in prohibited trading practices, Amadeux may:
● Consider it a breach of the 'Amadeux Challenge' terms.
● Terminate all services provided to the client andcancel the agreement.
● Prohibit access to services and the website. Take legal action in case of severe and continued policy violations, including reputational attacks.
14. Withdrawals
First Withdrawal: Users can withdraw profits from their funded account for the first time after 28 days from the first trade introduced in their funded account. Subsequently, they can request withdrawal every 14 days from the first trade after the previous withdrawal. Refund: When the client makes the first withdrawal from their account, the payment made to acquire the completed ‘Amadeux Challenge’ will be refunded.
Withdrawal Methods: Withdrawals can be transferred, at the user's choice, to their bank account with FIAT money (e.g: EUR, USD…) or cryptocurrency wallet (BTC, ETH, USDT…) without fees or with holdings from Amadeux. Withdrawal Times: Withdrawals are processed during business hours from Monday to Friday from 9:00 - 18:00, with an estimated withdrawal time of less than 5 hours from the request's receipt. The time it takes for the transaction to reflect in your account will depend on the chosen payment method and your banking entity.
15. Refund Policy
15.1 Termination Request: If the client wishes to terminate their account, they must send a request to support@amadeux.com before starting the program within 14 days. This will result in the loss of access to all services, including the trading platform.
16. Modifications to the Terms
We reserve the right to modify these Terms atany time. Any changes will be posted on our website, and if significant, we will notify you directly. Your continued use of the services after the publication of any modifications constitutes your acceptance of the modified Terms.
17. Governing Law and Jurisdiction
These Terms will be governed and interpreted by the laws of the USA. Any disputes arising in connection with these Terms willbe subject to the exclusive jurisdiction of the courts of the USA.
